We handle your personal data under the General Data Protection Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD).
2. What data we handle
- Contact form: your name, your email and the message you write.
- If you email or call us: the details you give us.
- Clients: the details needed to provide the contracted service and to invoice it.
- Technical data: like any web server, ours records the IP address and browser details of each visit in its access logs, for security.
The form fields are required: without them we cannot answer your enquiry.
3. Why we use it
- To answer the enquiries you send us.
- To manage the services a client contracts.
- To keep the website secure and prevent spam and abuse.
4. Legal basis
- Your consent, which you give when you send the contact form (article 6.1.a GDPR). You can withdraw it at any time.
- Performing a contract or taking steps at your request before one, such as a quote (article 6.1.b GDPR).
- Complying with legal obligations, such as keeping invoices for the periods set by tax and commercial law (article 6.1.c GDPR).
- Our legitimate interest in keeping the website secure, for the server logs and the anti-spam checks (article 6.1.f GDPR).
5. Who receives it
We do not share your data with third parties unless the law requires it. To run the website we use providers that handle data on our behalf:
- Our hosting provider, which serves the website and sends the contact form messages.
- Google (Google Workspace), where our email is hosted.
The website does not load anything from third parties: its typefaces and scripts are served from our own server, so visiting it does not send your IP address to any other company.
Google may process email data outside the European Economic Area. In that case it does so with the safeguards the GDPR requires, such as the European Commission's standard contractual clauses or the EU-US Data Privacy Framework.
6. How long we keep it
We keep your data for as long as needed to deal with your enquiry or the contracted service, and afterwards for the periods the law requires. Contact form messages are not stored on the web server: they are sent by email to info@kivomarketing.com. To stop spam, the form keeps a pseudonymised code (a keyed hash) of the sender's IP address and the time of sending, used only to limit repeated messages. Entries older than one hour, and the key that produced them, are deleted the next time the form is used.
7. Your rights
You can ask to access, rectify or erase your data, to restrict or object to its processing, and to receive it in a portable format, as well as withdraw your consent. Write to info@kivomarketing.com.
If you think we have not handled your data properly, you can lodge a complaint with the Spanish Data Protection Agency: www.aepd.es.
8. Security
Kivo Marketing applies technical and organisational measures to keep your data secure and confidential and to prevent unauthorised access, loss or alteration. The website is served over HTTPS.
9. Changes to this policy
We may update this policy to adapt it to new laws or to changes in how we work. The current version is always available on this page.
